Democratic States File Lawsuit Against Trump's Mail Voting Order

Democratic-controlled states filed a lawsuit on August 26, 2026, challenging President Donald Trump’s executive order aimed at limiting mail voting in the upcoming midterm elections. The lawsuit, initiated by approximately two dozen states against the U.S. Postal Service, follows a recent Supreme Court ruling that deemed the Democratic lawsuit premature but did not confirm the legality of Trump’s order. Election officials have expressed concerns that implementing the new rules will be unfeasible before mail ballots are distributed next week. New York Attorney General Letitia James stated, "Across the country, states are already deep into preparations for the 2026 elections. Now, at the last moment, the federal government is attempting to meddle in those preparations and potentially threaten countless Americans’ right to vote. USPS has no authority to decide who can and cannot vote by mail." Trump’s executive order is currently barred from taking effect due to a separate injunction, which the administration is seeking to have rescinded following the Supreme Court's ruling. The new Postal Service rule requires states to obtain federal approval for mail ballot envelope designs and to provide a list of eligible voters. White House spokesperson Lauren Bis described the Postal Service’s proposals as "commonsense measures that protect the security of mail-in ballots." The Postal Service declined to comment on the pending lawsuit. National Democrats have cited the new rule in their request for a federal judge to block Trump’s order. U.S. District Judge Indira Talwani previously found that the administration’s actions violated an existing injunction against Trump’s order but has not yet ruled on the request to revoke the second injunction issued on August 11. Trump has consistently criticized mail voting, which he attributes to his 2020 election loss, and has attempted to assert authority over election rules since returning to office.
