A Brooklyn landlord, Thomas Diana, has been involved in a lengthy legal dispute over unpaid rent and tenancy status that has lasted nearly nine years. Diana claims he has incurred significant financial losses due to the situation, which began when a woman moved into one of his apartments as a live-in companion for a disabled tenant who passed away in 2016. Since then, Diana has sought to remove the tenant, but the case has faced numerous delays in New York courts.
Court records indicate that the tenant has changed lawyers multiple times, complicating the legal proceedings. Diana argues that the tenant has not made rent payments for years, estimating the total owed to be between $275,000 and $325,000. He has also expressed frustration with the legal system, stating that the process is much longer than the typical eviction cases portrayed in media.
The tenant's attorneys dispute Diana's claims, stating that he improperly removed the apartment from rent stabilization protections. A judge has ruled that the apartment was incorrectly deregulated, and the ongoing court case is focused on determining the legal rent and any potential damages. Diana has created a GoFundMe page to assist with his financial burdens stemming from the case, which he describes as a systemic issue within New York's housing courts.
