A Delta Air Lines passenger, Cody James Maluck, 32, is facing a felony charge after allegedly slapping a flight attendant on the buttocks during an in-flight beverage service. According to court filings, Maluck was indicted by an Atlanta federal grand jury on June 9 for interfering with flight crew members and attendants. The incident occurred on May 9 aboard Delta Flight 800 from Fort Lauderdale to Los Angeles.
Prosecutors allege that Maluck made unwanted physical contact with the flight attendant, identified as P.L.L., while she was conducting beverage service. P.L.L. reported that she felt a slap strong enough to cause her to leap forward. After the incident, Maluck reportedly raised his hands and stated, "I didn’t do anything."
The flight crew decided to divert the flight to Hartsfield-Jackson Atlanta International Airport, where Maluck was taken into custody. He admitted to touching the flight attendant but disputed her account, claiming he was trying to get her attention while wearing headphones and did not hear her ask if he wanted a beverage.
Delta Airlines stated, "We have zero tolerance for unruly behavior and will work with law enforcement authorities in the prosecution of anyone who violates federal law while flying." If convicted, Maluck could face up to 20 years in federal prison.
