Social media companies, particularly Meta, have faced increasing legal scrutiny over the negative effects of their products on users' mental health and safety. Recently, a young woman was awarded three million dollars in a lawsuit claiming her mental health deteriorated due to social media use. In March and August, a court ordered Meta to pay nearly a billion dollars in fines and mandated changes to its business practices. In late 2022, over two dozen state attorneys general consolidated cases against Meta, alleging that it knowingly harmed vulnerable consumers, particularly teenagers and children.
The trial in Oakland concluded unexpectedly with Meta announcing a settlement worth at least twelve billion dollars, to be paid over ten years, and committing to various changes to its platforms. This settlement has drawn comparisons to the Tobacco Master Settlement of 1998, as it marks a significant acknowledgment by Meta regarding the impact of its business model on children. The settlement includes new limits on teenage use of its platforms, such as a daily cap of two hours and restrictions on access during late-night hours.
Additionally, the settlement promises ongoing oversight by a third-party auditor, a first for a technology company focused on child safety. The auditor will evaluate Meta's compliance with the settlement terms and report any failures to the states involved. However, the settlement does not address certain design features of Meta's platforms that have been criticized for promoting unsafe experiences, such as infinite scroll and autoplay.
The settlement also requires Meta to improve its age verification processes, which have been a point of contention in allegations of child harm. While the financial penalties are significant, they represent only a fraction of Meta's revenues. The settlement terms are also linked to the behavior of other social media companies, with potential additional payments if competitors like TikTok and YouTube adopt similar measures. Following the settlement announcement, Meta urged its competitors to implement similar restrictions, suggesting a strategic move to position itself as a leader in addressing these issues.
