Retired Judge Comments on Lindsay Clancy Murder Trial Jury Deliberations

Clancy, 36, faces three counts of first-degree murder in the deaths of her children—Cora, Dawson, and Callan—who were found strangled at their home in January 2023.</p><p>The jury concluded their deliberations on Tuesday after more than 23 hours over four days. In a note sent to Judge William Sullivan, jurors reported that they were unable to reach a unanimous decision. Sullivan instructed them to continue their deliberations.</p><p>“I brought you back out because I know that this was a long trial. All right, I know there were over 80 witnesses. There were over 300 exhibits. Because of that, I’m going to ask you to go back out, keeping in mind all of the instructions that I gave you to go out and to continue your deliberations at this time,” Sullivan said.</p><p>The jurors are considering several options, including first-degree murder, second-degree murder, voluntary or involuntary manslaughter, not guilty by reason of lack of criminal responsibility (insanity), or not guilty.</p><p>Retired Judge Jack Lu told Fox News Digital that the deadlock does not necessarily indicate a mistrial is imminent, and he believes a verdict is still achievable. “It is common for juries that eventually reach a verdict, especially in highly emotional cases, to initially report that they are deadlocked. So you could see a unanimous verdict later in this case,” Lu said. “There should be no rush to judgment.”</p><p>Lu emphasized that the jurors are addressing a complex societal issue and that no future jury will be better positioned to make such decisions. He also noted that Judge Sullivan was correct in not issuing a Tuey-Rodriguez charge to the jury, which would have urged them to continue deliberating toward a unanimous verdict. Lu stated that giving such an instruction at this stage would have been premature.</p><p>“It’s still too early, and we could go much longer on these deliberations, and it would be totally legitimate,” Lu added. Jurors are scheduled to return on Wednesday morning at 9 a.m. to continue their deliberations.</p>
