New Jersey School District Faces Lawsuit Over Gender Identity Policy

<p>A New Jersey school district is facing a lawsuit regarding its policy that allows students to change their name and gender identity at school without parental notification. The policy, implemented by the School District of the Chathams, permits students to alter their name in official records and use facilities that correspond with their gender identity, with school guidance counselors determining the extent of parental involvement.</p><p>The lawsuit claims that this policy contradicts a Supreme Court ruling in the case of Mirabelli v. Bonta, which issued an injunction against California policies that maintain student gender identity confidentiality from parents. Christopher Ferrara, senior counsel for the Thomas More Society, which filed the lawsuit, stated that the court has established that parents have the right to challenge policies that conceal gender transitions from them.</p><p>Ferrara highlighted concerns that the policy could negatively impact students who do not wish to transition, as they may be required to share facilities with students of the opposite sex. Additionally, Tina Descovich, CEO and founder of Moms for Liberty, one of the plaintiffs, alleged that students could face disciplinary actions for not using preferred pronouns of their peers.</p><p>The lawsuit, filed on August 24, includes two anonymous parents of elementary school-aged daughters as plaintiffs, who argue that the school is infringing on their First Amendment rights and the Due Process Clause of the 14th Amendment. They also assert that the school is violating parental rights affirmed in the Supreme Court ruling in Mahmoud v. Taylor, which allows parents to opt their children out of LGBT-centered lessons.</p><p>During a school board meeting on June 15, 2026, Ann Ciccarelli, president of the Chatham School District Board of Education, stated that the district is not obligated to adhere to the Mirabelli decision and must follow the New Jersey Department of Education's 2018 guidance on transgender students. However, New Jersey Attorney General Matthew Platkin acknowledged that Policy 5756 is not mandatory.</p><p>Descovich remarked that the guidance violates both the Mirabelli and Mahmoud rulings, asserting that the school board has a responsibility to uphold the constitutional rights of its community members. Ferrara indicated that parents opposing the policy have faced threats and intimidation, with one family reportedly requiring police security at their home.</p>
