Retired Teacher Wins Legal Battle Over Blocked Garden Access

Helene Ball, an 81-year-old retired teacher, returned home from shopping to find a green metal fence blocking access to her garden, which her family had used for nearly 60 years. The fence was erected by Derbyshire County Council, prompting a three-year legal dispute that concluded with Mrs. Ball winning £50,000 in costs and the right to access her garden. The council's actions began in April 2023, shortly before the second anniversary of her husband's death. The council claimed the fence was necessary to prepare the land for sale, but Mrs. Ball argued it was an infringement on her rights. After presenting evidence of continuous use of the access since 1967, a judge ruled in her favor in August 2026. Following the ruling, the council placed large concrete blocks outside her home, which Mrs. Ball views as a retaliatory act. The council stated the blocks were intended to prevent fly-tipping and ensure access for Mrs. Ball, but she expressed frustration over the ongoing situation. The council has since apologized for the distress caused and stated they have no current plans to sell the land.
