EEOC Proposes Ending 60-Year Requirement for Workforce Demographic Reports

The Equal Employment Opportunity Commission (EEOC) voted 2-1 to propose the elimination of a requirement for private sector employers to submit annual workforce demographic reports. This requirement has been in place for 60 years and is intended to help enforce anti-discrimination laws. The proposal is currently open for a 30-day public comment period before final approval. EEOC Chair Andrea Lucas stated that the requirement may promote racial stereotyping and encourage discrimination. Critics, including former Democratic EEOC commissioners and civil rights organizations, argue that ending the data collection will hinder the agency's ability to identify discrimination patterns. The EEOC has historically used this data to inform its enforcement priorities and investigations. The EEO-1 form, which has been required since 1966, collects data on job categories, gender, and race from companies with at least 100 employees. The data shows that while women and minorities have made some progress in executive roles, white men continue to dominate these positions. Lucas argued that the reporting requirements impose significant costs on employers without evidence of discrimination, while critics maintain that tracking this data is essential for promoting workplace equality.
