Small Businesses File New Legal Challenges Against Trump's Tariffs

Small businesses that previously challenged President Trump's trade policies are filing lawsuits to block the latest round of tariffs. These lawsuits represent another legal examination of Trump's tariff policies, following recent court rejections of previous tariff regimes. One lawsuit is filed on behalf of Burlap & Barrel and watch retailer Collective Horology, while another is brought by toymaker Learning Resources, which previously won a Supreme Court case against Trump's tariffs. The lawsuits contest the new tariffs imposed under Section 301 of the Trade Act, which took effect last week after the expiration of temporary tariffs under Section 122. These tariffs impose rates of 10% or 12.5% on imports from over 60 economies, which the Trump administration claims have not adequately addressed forced labor in their supply chains. The Liberty Justice Center, representing some of the businesses, argues that the administration has misapplied Congress's intent for targeted trade remedies. Collective Horology co-founder Asher Rapkin stated that previous tariffs have significantly impacted their business, costing them over $160,000. The White House has defended the tariffs as a legitimate use of Section 301, aimed at addressing unfair trading practices. Small businesses continue to play a significant role in challenging the administration's tariff authority.
