DOJ Introduces Process for Restoration of Federal Gun Rights for Certain Individuals

On August 17, 2026, Attorney General Todd Blanche announced a new process allowing individuals barred from possessing firearms to apply for the restoration of their federal firearm rights. According to the final rule, applicants must demonstrate the circumstances of their prohibition and show they do not pose a danger to public safety. Blanche stated, "The Second Amendment is not a second-class right... This rule establishes a rigorous, commonsense process that protects the public while giving deserving Americans a real path to restoration." The Justice Department noted that violent felons, registered sex offenders, illegal aliens, and others deemed a danger will remain ineligible for relief. The National Rifle Association (NRA) expressed support for the rule, stating it is a step towards restoring Second Amendment rights for individuals who have paid their debts to society. The announcement follows a recent ruling allowing individuals to possess certain firearms without federal registration.
