Douglas Stewart Carter, 71, was released from the Utah County Jail late Monday on bail while awaiting a new trial in the 1985 killing of Eva Olesen, after newly analyzed DNA evidence excluded him as the source of DNA from key evidence, prosecutors said.
Carter had spent decades on death row following his conviction in Olesen’s killing. He must wear a GPS monitor and cannot contact Olesen’s family; the judge granted release despite the family’s objections, according to Fox News. The Utah Supreme Court ordered a new trial last year, citing misconduct by investigators, Fox News and the New York Post reported. Carter has maintained his innocence, the Post reported.
