A federal judge in Washington on Tuesday did not immediately rule on ABC’s request to halt the Federal Communications Commission’s early review of broadcast licenses held by several local ABC stations.

ABC’s lawyer asked U.S. District Judge Loren Alikhan for a preliminary injunction, arguing that the review was unconstitutional, violated free-speech protections and retaliated against content President Donald Trump dislikes. The lawyer said the process was affecting the network’s editorial decisions ahead of the U.S. midterm elections. Alikhan questioned the administration’s justification for beginning the review, according to The Hill.

FCC leader Brendan Carr has said the review of Disney’s local broadcast licenses arose from an investigation into the company’s diversity and inclusion employment practices, according to The New York Times. Alikhan has not yet decided whether to stop the review.
