A state appeals court on Wednesday reversed a lower court ruling against New York City Mayor Zohran Mamdani’s annual surcharge on certain high-value second homes, allowing the administration to continue implementing the measure.
The appellate panel dismissed homeowners’ lawsuit after finding the plaintiffs lacked legal standing, according to the Washington Examiner and Fox News. The Examiner said the court found they had not shown a concrete injury from the tax or publication of property information. The Hill said the lower court had found the city’s Finance Department violated plaintiffs’ due process rights in deciding who would pay.
The decision overturns a September ruling by a Staten Island judge, the Examiner and Fox News reported. Fox News said the tax faces separate legal challenges.
